ضمانات العلاقات السياسية حال الحرب في الفقه الإسلامي و القانون الدولي

ملخص
جاء الإسلام وأراد أن يوثق العلاقات الدولية سياسياً ودبلوماسياً..في حربه وسلمه, فقدظن البعض أن الحرب في الإسلام تلغي العلاقات الدولية، وهو ادعاء غير صحيح، وسيتبين لدينا من خلال المقارنة مع القانون الدولي سمو الشريعة في هذا الجانب, لقد قدم الإسلام الضمانات الحقيقية, لاستمرار العلاقات الدولية، بأمر رباني, حيث ألزم الجميع تطبيقه, أما القانون الدولي فقد جعلها تعليمات لا تتجاوز مجال الوعظ والإرشاد, يُلتزم بها بحسب قوة الواعظ وبطشه, هذا البحث يرصد معالم الضمان لهذه العلاقات, ويقارن ما بين الشريعة والقانون الدولي.

Some thought that the war in Islam would abolish international relations, It is an incorrect claim, In comparison with international law, we will find the supremacy of Islamic Sharia in this regard, Islam has provided real guarantees for the continuation of international relations by Allah order, Where everyone was obligate to apply it, As for international law, it has made it instructions that do not exceed the area of ​​preaching and guidance, obligate to apply it pursuant to the strength of the preacher and his violence, This research measures the Guarantees of these relations, and compares between Islamic Sharia and international law.
