إذن ولي الأمر في الإجراءات العلاجيّة والعمليّات الطبيّة في الفقه الاسلامي

الملخص :
إن ديننا الإسلامي أتى بعلاج کل المشکلات بالعلاج الأمثل مهما کان شأنها . وهذا من روائع الإعجاز في هذا الدين , وآية من آيات عمومه وخلوده , وصلاحيته لکل زمانٍ ومکان، فهو لم يدع جانباً من جوانب الحياة الإنسانيّة , إلاّ کان له فيه موقف، ولم يدع طوراً من أطوار حياة الإنسان إلا ورسم له فيه المنهج الأمثل، ومن جملة ما رسم منهاجه , وحدّد قيوده , الإجراءات العلاجيّة , والعمليّات الطبيّة. ومن رحمة الله تعالى أن اعتبرت الشريعةُ الإسلاميّة الولاية على الغير في حال عجز ذلک الغير عن النظر في مصالحه , ولم يأذن الله بإعطائهم أموالهم حتى يؤنس منهم الرشد, قال تعالى : {وَابْتَلُوا الْيَتَامَى حَتَّى إِذَا بَلَغُوا النِّکَاحَ فَإِنْ آنَسْتُمْ مِنْهُمْ رُشْداً فَادْفَعُوا إِلَيْهِمْ أَمْوَالَهُمْ}(النساء: من الآية6)، وامتداداً لهذه القاعدة فقد اشترط الفقهاء لإباحة العمل الطبّي أن يأذن ولي المريض متى کان المريض غير أهلٍ للإذن . ومن هنا جاء الکلام في هذا البحث عن اذن ولي المريض في الإجراءات العلاجيّة  والعمليّات الطبيّة لمن هو تحت ولايته ، وسوف اتناول في هذا البحث مفهوم الاذن الطبي وانواعه وشروطه ثم بيان اذن ولي الامر حکمه عند الفقهاء وضوابطه ، وبيان الحالات التي يتعذر فيها الاذن الطبي، وهذا اسهاما متواضعا للکشف عن روائع الاعجاز في هذا الدين الاسلامي، وأنه صالح لکل زمان ومکان .

The Guardian's Permission for Remedial Procedures and Medical Operations in Islamic Jurisprudence
Our Islamic religion has brought about the treatment of all problems with the optimal treatment, whatever their cause. This is one of the masterpieces of miracles in this religion, and a verse of its general and eternal verses, and its validity for every time and place. He did not call an aspect of human life, but he had a position in it. He did not invite one of the phases of a person’s life, except in which he drew the optimum method. Among other things, he outlined his curriculum, defined its limitations, treatment procedures, and medical operations. And it is from the mercy of God Almighty that the Islamic Sharia considered guardianship over others in the event that others are unable to consider his interests, and God did not authorize them to give them their money until human beings have become rational. Women: From verse 6).Just as the guardian must keep the money, so must the body. As an extension of this rule, the jurists required the legalization of medical work to authorize the patient's guardian when the patient was not qualified to authorize. Hence the speech in this research came about the permission of the patient's guardian in the remedial procedures and medical operations of the one under his jurisdiction, and I will address in this research the concept of medical permission and its types and conditions, then clarify the permission of the guardian's ruling on jurists and its controls, and the statement of cases in which medical permission is impossible. This is a modest contribution to reveal the masterpieces of miracles in this Islamic religion, and it is valid for every time and place..
